Privacy Policy

WAIN99 Trading LLC (和飲九九貿易合同会社, "we" or "the Company") sets out below how we handle the personal information of users of the services we provide on this website ("the Service").

1. Personal information

"Personal information" has the meaning given in Japan's Act on the Protection of Personal Information: information about a living individual by which that individual can be identified, such as name, date of birth, address, telephone number and other contact details, together with information that identifies an individual on its own, such as facial image, fingerprint or voiceprint data and a health-insurance card insurer number.

2. How we collect personal information

We may ask for personal information such as your name, date of birth, address, telephone number, email address, bank account number, credit card number or driving licence number when you register to use the Service. We may also receive transaction and payment records containing your personal information from our partners, including information providers, advertisers and advertising networks.

3. Why we collect and use personal information

  1. To provide and operate the Service.
  2. To answer your enquiries, including verifying your identity.
  3. To email you about new features, updates and campaigns for services you use, and about our other services.
  4. To contact you when necessary, for example about maintenance or important notices.
  5. To identify and refuse service to users who breach our terms or who use the Service for improper purposes.
  6. To let you view, change or delete your own registration details and view your usage.
  7. To bill you for paid services.
  8. For purposes incidental to the above.

4. Changes to the purpose of use

We will change the purpose for which we use personal information only where the new purpose is reasonably regarded as related to the original one. If we do change it, we will notify users or publish the change on this website.

5. Disclosure to third parties

We do not disclose personal information to third parties without your prior consent, except where permitted by the Act on the Protection of Personal Information or other law, including:

  1. where disclosure is necessary to protect a person's life, body or property and consent is difficult to obtain;
  2. where disclosure is particularly necessary to improve public health or promote the sound upbringing of children, and consent is difficult to obtain;
  3. where we must cooperate with a national or local government body, or a party it has commissioned, in carrying out duties prescribed by law, and obtaining consent would impede those duties;
  4. where we have given prior notice or publication of the matters required by law and notified the Personal Information Protection Commission.

The following recipients are not treated as third parties: contractors handling personal information on our behalf within the scope necessary for the stated purposes; a successor to our business through merger or similar; and parties with whom we jointly use personal information, where we have given prior notice of the items used, the scope of joint users, their purpose and the party responsible for managing the information.

6. Disclosure to you

If you ask us to disclose the personal information we hold about you, we will do so without delay. We may withhold all or part of it, and will tell you promptly if we do, where disclosure would harm the life, body, property or other rights of you or a third party, would seriously impede our business, or would breach the law. A fee of 1,000 yen per request applies. Information that is not personal information, such as browsing history and attribute data, is not disclosed as a rule.

7. Correction and deletion

If the personal information we hold about you is incorrect, you may ask us, using our prescribed procedure, to correct, add to or delete it. Where we decide the request should be met, we will act without delay. We will tell you promptly whether or not we have made the change.

8. Suspension of use

If you ask us to suspend or erase your personal information on the grounds that it is being handled beyond the stated purposes or was obtained improperly, we will investigate without delay and, where we decide the request should be met, act without delay. We will tell you promptly whether or not we have done so. Where suspension would be difficult or disproportionately costly, we will take alternative measures to protect your rights.

9. Changes to this policy

Except where the law or this policy provides otherwise, we may change this policy without notifying users. Unless we state otherwise, the revised policy takes effect when posted on this website.
